This Privacy Policy explains how Abhi Bathla, a licensed Mortgage Agent Level 2 (FSRA Lic. #M16001438) with Dominion Lending Centres National Ltd. (FSRA Brokerage Lic. #12360), independently owned and operated (“we,” “us,” “our”), collects, uses, discloses, and protects your personal information in connection with this website and the “Mortigator” AI assistant featured on it, in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable Ontario law.

1. Information We Collect

When you use this website, chat with the Mortigator AI assistant, submit our assessment survey, call, text, or email us, we may collect:

• Contact information — name, phone number, email address, and city/postal code.
• Property and financial information you choose to share — such as approximate property value, mortgage balances, income type, credit situation, and the nature of your mortgage need.
• Communication records — messages, call notes, AI assistant chat transcripts, and correspondence related to your inquiry.
• Technical information — device, browser, pages visited, and approximate location, collected through cookies and analytics tools (see Section 7).

The free assessment and the Mortigator AI assistant do not perform a credit check. If a credit report is ever required for a specific lender option, we will obtain your express consent first.

2. How We Use Your Information

• To respond to your inquiry and assess your mortgage options;
• To prepare, process, and submit mortgage applications you authorize;
• To communicate with you about your file, including by phone, SMS/text, and email;
• To send marketing or educational communications where you have provided consent (see Section 6);
• To meet our legal and regulatory obligations under the Mortgage Brokerages, Lenders and Administrators Act, 2006 (Ontario) and FSRA requirements; and
• To improve this website, the Mortigator AI assistant, and our services.

3. The Mortigator AI Assistant & Automated Chat

This website features “Mortigator,” an AI-powered chat assistant that helps visitors learn about private and alternative mortgage solutions and collects initial information about your situation. When you interact with Mortigator:

• Your messages and the information you provide may be processed by third-party AI and automation service providers on our behalf, under confidentiality and data-processing terms consistent with this Policy;
• Your conversation is reviewed by Abhi Bathla, or a supervised team member, before any mortgage-related action is taken on your file — Mortigator does not make lending or credit decisions on its own; and
• You should avoid sending highly sensitive information (e.g., SIN, full banking credentials, or passwords) through the chat; we will request sensitive documents through a secure channel when needed.

4. When We Share Your Information

We do not sell your personal information. We may share it only as needed to serve you, including with:

• Lenders and lender underwriters you authorize us to approach on your behalf;
• Dominion Lending Centres National Ltd., our licensing brokerage, for supervision and compliance purposes;
• Service providers who support our operations (e.g., CRM, AI assistant/automation, scheduling, communication, and document platforms) under appropriate confidentiality obligations — some of these providers may store or process data on servers located outside Canada, including in the United States, and by using this site you acknowledge your information may be subject to the laws of those jurisdictions;
• Professional advisors involved in your transaction (e.g., appraisers, lawyers, insolvency trustees) with your knowledge; and
• Regulators or authorities where required by law.

5. Consent

By submitting our assessment survey, chatting with Mortigator, or contacting us, you consent to the collection and use of your information for the purposes described above. You may withdraw consent at any time, subject to legal and contractual restrictions, by contacting us — though doing so may limit our ability to assist with your mortgage needs.

6. Marketing Communications, SMS & CASL

In compliance with Canada's Anti-Spam Legislation (CASL), we send commercial electronic messages, including SMS/text messages, only with your consent or as otherwise permitted by law. Message frequency varies; message and data rates may apply. Reply STOP to any text to unsubscribe, or HELP for assistance. Every marketing email or text includes a working unsubscribe mechanism, and unsubscribe requests are honoured promptly. Transactional messages about your active file are not affected by unsubscribing from marketing.

7. Cookies, Analytics & Do Not Track

This website may use cookies, pixels, and analytics tools to understand site usage and improve performance. You can control cookies through your browser settings; disabling them may affect some site functionality. This site does not currently respond to browser “Do Not Track” signals.

8. Safeguards & Retention

We use reasonable administrative, technical, and physical safeguards appropriate to the sensitivity of the information we hold. We retain personal information only as long as needed for the purposes described here and to meet regulatory record-keeping requirements applicable to licensed mortgage professionals in Ontario, after which it is securely destroyed or anonymized. In the event of a data breach involving your personal information that poses a real risk of significant harm, we will notify you and the appropriate regulator(s) as required by law.

9. Children's Privacy

This website and the Mortigator AI assistant are intended for adults seeking mortgage financing and are not directed at, or knowingly used to collect information from, individuals under the age of 18.

10. Your Rights

Subject to applicable law, you may request access to or correction of the personal information we hold about you, ask questions about our practices, or make a complaint. Send your request to the contact details in Section 11 and we will respond within a reasonable time. You may also contact the Office of the Privacy Commissioner of Canada if you are unsatisfied with our response.
